Legal Battle over Nassau University Medical Center Board.

  David Mejias, a well-known attorney in Nassau County, is involved in a legal dispute over the leadership of the board that runs Nassau University Medical Center. The conflict centers around the appointment of two individuals to a board seat, one appointed by the former county executive and the other by the current county executive.

 

Judge Temporarily Bars Matthew Bruderman from Board Seat

 

On Wednesday, a judge ordered a temporary injunction preventing Matthew Bruderman, the board chairperson chosen by Nassau County Executive Bruce Blakeman, from assuming office. Ann Kayman, a trustee who was chosen by previous County Executive Laura Curran, was reinstated by the ruling. Judge Randy Sue Marber issued an injunction preventing Bruderman from holding the same position to which Ann Kayman was nominated on or around December 17, 2021, as a Director and/or Chair of the Board of Nassau Health Care Corporation. Marber ruled that Kayman must continue serving on the NHCC board. The next court date is set for April 18, and the temporary restraining order will be in effect until the matter is addressed.

 

A lawsuit filed by Ann Kayman

 

In a lawsuit submitted to the State Supreme Court, Republican Blakeman, who also serves as the board head of NuHealth, also known as the Nassau Health Care Corp., was accused of firing Kayman unfairly to make room for Bruderman. Kayman argues that it was lawful for her to be appointed to the board. Blakeman named Centre Island-based financial expert and Republican Party supporter Bruderman to the NuHealth board on March 4.

 

Arguments by Blakeman Administration

 

The Blakeman administration maintains that Bruderman was properly and legally appointed as a trustee and board chairman on March 4. Thomas Adams, the Nassau County Attorney and a Blakeman appointee, claimed that Curran, a Democrat, lacked the power to nominate Kayman to the board position previously held by Warren Zysman. According to representatives of the Blakeman administration, Zysman's appointment wasn't due to expire until this year.

 

Counter Arguments by Dave Mejias

 

The arguments put forth by the Blakeman administration were rejected by Ann Kayman's attorney, Dave Mejias. Mejias contended that it was improper for former County Executive Edward Mangano, a Republican, to re-nominate Zysman for a second five-year term in 2017 while Zysman was still serving his first term. He made notice of the fact that Zysman was appointed to a five-year term commencing in 2014 by Mangano. 2019 was the conclusion of Zysman's appointment, according to Kayman's lawsuit.

 

Kayman failed to file her oath card within 30 days of her appointment, according to Robert Spolzino, outside counsel for the hospital and a lawyer with the firm Abrams Fensterman. This, he claimed, rendered her appointment ineffective.

 

Concluding Thoughts

 

DavidMejias, Oyster Bay Town Democratic leader and a former Democratic County legislator, stated that Bruderman "can't be the chairman of the board he's not a member of" and suggested that "if Blakeman really wants him on the board, he can appoint him to another seat." The legal dispute over the leadership of the Nassau University Medical Center board continues, with the next hearing date scheduled for April 18.
